Terms of Service

These Terms of Service ("Terms") apply to the website themes, templates, modules and related documentation (together, the "Themes") published by Takshvi Agency ("Takshvi", "we", "us") on the HubSpot Template Marketplace, and to the support we provide for them. By installing or using a Theme you agree to these Terms. They apply in addition to HubSpot's own marketplace terms; if the two conflict, HubSpot's terms govern the purchase and installation process.

1. Licence

When you install a Theme from the HubSpot Template Marketplace (free or paid), we grant you a non-exclusive, non-transferable licence to use and customise that Theme within the HubSpot account into which it was installed, for your own websites or for websites you build for a client inside that client's HubSpot account.

You may not resell, sublicense, redistribute or share the Theme files, or any part of them, as a theme, template or stock product, whether or not you have modified them, and you may not remove copyright or licence notices from the files.

2. Ownership

The Themes, including their code, design, documentation and original graphics, remain the property of Takshvi Agency or its licensors. Content you add to a Theme (your text, images, data and branding) remains yours. Third-party services used at runtime, such as Google Fonts, map and video embeds, and HubSpot's built-in modules, are subject to their own terms.

3. Demo content

Example images, text and logos shown on our demo pages and listing screenshots are for illustration only and are not licensed for use on your website. Replace them with content you own or are licensed to use.

4. Purchases, refunds and updates

Paid Themes are sold and paid for through HubSpot. Pricing, payment, taxes and refund requests are handled under HubSpot's Template Marketplace policies. We may release updates to a Theme to add improvements or fix issues; updates are delivered through HubSpot at no extra cost to existing customers.

5. Support

We provide free support for our Themes by email at support@takshvi.agency, Monday to Friday, 10:00–18:00 India Standard Time, and aim to reply within two business days. Support covers installing the Theme, connecting menus, forms and the blog, questions about theme settings and module fields, and fixes for issues caused by the Theme. It does not cover custom development, third-party integrations, or problems caused by changes to the Theme's code.

6. Acceptable use

You are responsible for the content you publish with a Theme and for complying with the laws that apply to your website, including privacy, accessibility and consumer-protection laws.

7. Disclaimer

The Themes are provided "as is". We work to keep them reliable, accessible and compatible with HubSpot, but we do not guarantee that they will be error-free, will meet every requirement, or will remain compatible with future changes HubSpot makes to its platform.

8. Limitation of liability

To the fullest extent permitted by law, Takshvi Agency is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of a Theme. Our total liability for any claim relating to a Theme is limited to the amount you paid for that Theme.

9. Termination

Your licence ends automatically if you breach these Terms. On termination you must stop using the Theme and remove it from your HubSpot account.

10. Changes to these Terms

We may update these Terms from time to time. The effective date above shows when they last changed. Continued use of a Theme after an update means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and disputes are subject to the jurisdiction of the courts of India.
